   3 1. The Debian Technical Committee hereby exercises its power in
   4    4.2(1) of the Debian Constitution to propose the following
   5    General Resolution:

   9    Constitutional Amendment: TC Supermajority Fix

  11    Prior to the Clone Proof SSD GR in June 2003, the Technical
  12    Committee could overrule a Developer with a supermajority of 3:1.

  14    Unfortunately, the definition of supermajorities in the SSD GR has a
  15    fencepost error.  In the new text a supermajority requirement is met
  16    only if the ratio of votes in favour to votes against is strictly
  17    greater than the supermajority ratio.

  19    In the context of the Technical Committee voting to overrule a
  20    developer that means that it takes 4 votes to overcome a single
  21    dissenter.  And with a maximum committee size of 8, previously two
  22    dissenters could be outvoted by all 6 remaining members; now that
  23    is no longer possible.

  25    This change was unintentional, was contrary to the original intent
  26    of the Constitution, and is unhelpful.

  28    Additionally, following discussion of the supermajority mechanism
  29    within the project, it was realised that certain situations could
  30    cause anomalous results:

  32    * The existing rules might result in a GR or TC resolution passing
  33      which was actually the diametric opposite of the majority view.

  35    * The existing rules unintentionally privilege the default option
  36      in evenly contested TC votes where no supermajority is required,
  37      possibly encouraging tactical voting.

  39    Therefore, amend the Debian Constitution as follows:

  41    (i) Delete most of A.6(3) (which implemented the supermajority
  42    by dropping options at an early stage).  Specifically:
  43       - Move A.6(3)(1) (the definition of V(A,B)) to a new subparagraph
  44         A.6(3)(0) before A.6(3)(1).
  45       - Remove the rest of A.6(3) entirely, leaving A.6(2) to be
  46         followed by A.6(4).

  48    (ii) In A.6(8) replace all occurrences of "winner" with
  49    "prospective winner".  Replace "wins" in "which of those options
  50    wins" with "is the prospective winner".

  52    (iii) In A.6(8) add a new sentence at the end:
  53      + If there is no elector with a casting vote, the default option
  54      + wins.

  56    (iv) Add a new section A.6(9) after A.6(8):
  57      + 9. 1. If the prospective winner W has no majority requirement,
  58      +       or defeats the default option D by its majority
  59      +       requirement, the prospective winner is the actual winner.
  60      +    2. Otherwise, the motion has failed its supermajority with
  61      +       the consequences set out alongside the majority
  62      +       requirement (or, if unspecified, the default option
  63      +       wins).
  64      +    3. An option A defeats the default option D by a
  65      +       majority of N:M if M * V(A,D) is greater than or equal to
  66      +       N * V(D,A).

  71            constitutional amendment has not abolished that
  72            supermajority requirement)
  73    in each case after the "N:M majority" add
  74      +   ; failing that, the prospective winning resolution text becomes
  75      +   a non-binding statement of opinion.

  77    (vi) In A.3(2) delete as follows:
  78          2. The default option must not have any supermajority requirements.
  79      -       Options which do not have an explicit supermajority requirement
  80      -       have a 1:1 majority requirement.

  82    For the avoidance of any doubt, this change does not affect any
  83    votes (whether General Resolutions or votes in the Technical
  84    Committee) in progress at the time the change is made.

  86    The effect is to fix the fencepost bug, and arrange that failing a
  87    supermajority voids the whole decision (or makes it advisory),
  88    rather than promoting another option.  The fencepost bugfix will
  89    also have a (negligible) effect on any General Resolutions
  90    requiring supermajorities.  And after this change the TC chair can
  91    choose a non-default option even if it is tied with a default
  92    option.
